Yes, that sounds like the best solution for future versions, but

regardless of the current state of the draft (or upcoming RFC), the
DNT-header is already implemented by most browsers and not forwarding it
may have some serious impact on what users are expecting when they
enabled DNT in their browser (not forwarding the header means disabled),
which might be a source of trouble for administrators.

And this small patch helps (and should work for older versions too).
