Well... technically 304 also has a entity, but the terms are a bit
diffuse there so it goes into the category "might".

For your ACL the locigs should be

 There is a content-type header
   OR
 There must be a entity (use a dummy "UNKNOWN" or a similar value if
there is no content-type header)
